Status of this draft

These draft terms are provided for transparency while ATH3NA prepares for external UK legal review. They are not effective customer terms and do not permit commercial launch.

Operator and service

ATH3NA is a software service operated by Brazhelp Solutions. It provides record keeping, performance measurement and, only where separately approved, analytical information. ATH3NA is not a broker, does not hold customer money, and does not execute or arrange transactions.

Eligibility and accounts

The initial service is intended for United Kingdom residents aged 18 or over who can enter a binding contract. Account information must be accurate, credentials must remain confidential, and users must notify ATH3NA promptly of suspected compromise.

User-owned records

Customers retain their rights in journal records and uploads. They grant the limited rights needed to host, process, secure, back up and display those records for the contracted service. Customers must have authority to upload the material and must not upload unlawful or third-party confidential information.

Service operation

ATH3NA may maintain, secure, change or discontinue features. Material changes, planned maintenance and any effect on paid access should be communicated under the applicable contract. Availability is not guaranteed without an agreed service level.

Intellectual property

ATH3NA software, interfaces, analytical methods, branding and documentation remain the property of their respective owners. Access is a limited, revocable, non-transferable right for the contracted purpose and does not transfer source code, prompts, provider data, or proprietary methods.

Suspension and termination

Access may be suspended for security, material breach, non-payment, unlawful use or provider restrictions, subject to applicable law and fair notice where practicable. Termination, data return, deletion, refunds and surviving obligations must follow the applicable contract and statutory rights.

Responsibility and liability

Nothing in these draft terms excludes liability that cannot lawfully be excluded. Any final limitations must be reasonable, transparent and reviewed against the customer type, service supplied and applicable consumer law. Customers remain responsible for investment and trading decisions.

Law, complaints and contact

The intended governing law is England and Wales, subject to mandatory consumer protections. Complaints should follow the published complaints process. Operator identity, address, contact channels and dispute provisions require solicitor confirmation before publication.
